This Service Agreement (“Agreement”) is entered into between 6ixporch (“Company,” “we,” “us,” or “our”) and the customer (“Customer,” “you,” or “your”) for seasonal porch decorating services. By placing an order and accepting our services, you agree to be bound by the terms and conditions outlined in this Agreement.

1. Service Description

6ixporch provides seasonal porch decorating services, including delivery, installation/layout, design consultation, removal, and disposal services. Services may feature pumpkin displays, floral arrangements, seasonal décor, and related decorative items.

2. Customer Responsibilities

2.1 Property Access & Safety

  • Access Requirements: Provide safe, unobstructed access to your property on the scheduled service date (e.g., unlock gates, clear pathways, ensure lighting if service occurs in the evening).
  • Pet Safety: Pets must be secured in a separate area away from the work zone.
  • Property Hazards: Inform us of any hazards (loose boards, electrical issues, unstable surfaces).
  • Accurate Information: Provide correct delivery details and access instructions. Photos of the porch area may be requested for planning.

2.2 Communication Requirements

  • Responsiveness: Reply within 48 hours when confirmation or details are requested.
  • Schedule Confirmation: Confirm delivery/removal dates at least 3 days in advance.
  • Changes: Notify us of changes at least 7 days before scheduled delivery.

2.3 Payment Obligations

  • Payment must be processed before service delivery.
  • Failed payments may result in cancellation and rescheduling fees.

3. Company Responsibilities

3.1 Service Delivery

  • Deliver and install decorations according to your package.
  • Handle products with care during transport/installation.
  • Clean up any debris created during setup.

3.2 Quality Assurance

  • Replace significantly damaged or rotting items reported within 3 days of delivery.
  • Offer upgrades or adjustments when delays are caused by our circumstances (subject to availability).

4. Limitation of Liability

4.1 Property Damage

  • We are not liable for dissatisfaction with approved designs.
  • We are not responsible for damage caused by pre-existing structural issues or undisclosed hazards.
  • Minor surface marks from décor placement are considered normal and not covered.

4.2 Product Security & Weather

  • After installation, the customer assumes responsibility for theft, vandalism, or damage.
  • Weather-related damage is not covered. Customers should protect items from standing water or severe weather.

4.3 Supply Chain Issues

  • Seasonal availability may affect products. Refunds or substitutions will be provided if necessary.
  • We are not liable for delays caused by supplier failures or inventory loss.

4.4 Access & Communication Failures

  • Missed or blocked access may result in rescheduling fees.
  • Failure to provide requested information may delay or cancel service.

5. Personal Injury & Safety

  • Customers are responsible for maintaining a safe property environment.
  • Injuries caused by undisclosed hazards or unsecured pets are the customer’s liability.
  • Our team follows safety protocols and maintains insurance coverage.

6. Data Security & Privacy

  • We take reasonable steps to protect your information.
  • Customer data will only be used for service delivery and communication.
  • Photos of decorated porches may be used for marketing unless you opt out by emailing info@6ixporch.ca.

7. Force Majeure & Delays

  • We are not responsible for delays caused by natural disasters, severe weather, supply failures, or public emergencies.
  • If delays are caused by us, we will reschedule promptly and may offer service upgrades.

8. Damage & Replacement Policies

  • Items damaged by us during delivery/installation will be replaced at no cost.
  • Customers must report quality issues within 3 days of delivery.

9. Payment & Cancellation

  • Payment: Must be completed before delivery.
  • Cancellation Terms:
    • 14+ days before delivery → Full refund
    • 10–13 days before delivery → 50% refund
    • Within 10 days → Non-refundable
  • Force majeure cancellations → Full refund or credit

10. Dispute Resolution

  • Customers must first attempt resolution directly with 6ixporch.
  • Our liability will not exceed the amount paid for the specific service.

11. Indemnification

Customers agree to indemnify and hold harmless 6ixporch from claims or expenses arising from:

  • Failure to disclose property hazards
  • Unsecured pets during service
  • Denied property access
  • Violation of this Agreement

12. General Terms

  • Governing Law: This Agreement is governed by the laws of Ontario, Canada.
  • Modifications: Only valid in writing and signed by both parties.
  • Severability: Invalid provisions do not affect the rest of the Agreement.
  • Entire Agreement: This Agreement + our Website Terms of Service form the full contract.
